The owner builder :
Owner Builder as the term suggests the owner builds his own house or improvement. This method of construction can save one a substantial amount of money if completed carefully and methodically. To do this one has to follow guidlelines and good advice. You become the project manager. Always draw up a contract with any service provider or contractor.
To be legal the contract must amongst others be :-
Written in a language understood by the parties , each would read , sign in full, date and indicate place of signature. One or two witnesses are required.
A witness not related to any of the parties to the contract will help in disputed issues that may go to court. This does not preclude a family member or friend from signing as a witness. The contract must indicate the total number of pages and if there are any addendums to the contract. Parties to the contract should initial the bottom of each page and by so doing acknowledge that they have read and understood the contents of each page. Any alterations must be struck off and corrected. This correction must be accompanied by full signatures of parties to the contract. Hand written entries made on a contract are normally accompanied by the full signatures of the parties to the contract.
Guidance
A contract should not leave an opportunity for speculation, guesswork and delay. The name of the contractor, business registration number and address must be on the contract. The contract must specify the work to be undertaken and the specific details of material to be used. Always specify that SABS materials must be used. The grade and standard of materials must be specified, such as grade 1 polished ceramic tiles. Colour schemes and choices made must clearly communicated in writing to the contractor. Draw up a list of material with specifications and types chosen. State clearly when work should commence and the expected time of completion. Builders are normally allotted three months to construct a house. This time frame must be mutually agreed to. Note that some contractors take on multiple jobs. You must be compensated should there be a delay for any unreasonable situation. Include this in your contract. All payments must be agreed to as in the contract. Do not deviate !! You are bound to hear many stories. Some contractors are very convincing and will sweep off your feet. Only pay after work is completed. Example after foundation of house is passed by your local authority building inspector.
The next payment should be after the walls are raised to the ceiling level. Therafter, your final payment should be after the building is passed for occupation.
Get the occupation certificate in your hand before paying.
Governing Councils such as NHBRC and Industry Related Associations such as Master Builders South Africa will assist an owner Builder. Contract with
